Sir,

This is to give notice that the as per the call given by the Confederation of Central Government Employees and Workers (CCGEW) and National Federation of Atomic Energy Employees (NFAEE) employees who are members of the this association will go on one day's strike on 28th February, 2012. The charter of demands in pursuance of which the employees will embark upon the one day strike action is enclosed.

PART-A.

1. Concrete measures to contain price rise.

2. Concrete measures for linkage of employment protection with the concession/incentive package offered to the entrepreneurs,

3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws

4. Universal social security covers for the unorganized sector workers without any restriction

5. Creation of a National Social Security Fund with adequate resources in line with the recommendation, of NCEUS and Parliamentary Standing Committees on Labour, Stoppage of disinvestment in Central and State PSUs, the Central Trade Unions also demand immediate action by the Govt. of India to en sure:

6. No Contractorisatlon of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the Industry/establishment

7. Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs 10,000/-,

8. Remove the ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

9. Scrap PFRDA Bill/New Pension Scheme; Ensure pension for all.

10. Compulsory registration of trade unions within a period of 45 days and immediate ratification of ILO conventions 87 and 98.

PART-B

1. Stop downsizing, outsourcing, contractorisation, coporatorisation and privatization of Governmental functions.

2.Fill up all vacant posts and create posts on functional requirements.

3. Revise wages of CGEs with effect from 1.1.2011 and every five years thereafter.

4. Regularize the GDS, daily rated workers, contingent and casual workers by bringing about a definite scheme of regularization.

5. Remove restriction imposed on compassionate appointment (end the discrimination on compassionate appointment between the Railway workers and other CGEs).

6. Stop the move to introduce the productivity linked wage system; Performance related pay; introduce PLB in all Departments; remove the ceiling of emoluments for bonus computation.

7. Settle all items of anomalies (including the MACP related anomalies) raised in the National and Departmental Anomaly Committee within a fixed time frame of two months; Set up the anomaly committees in those Departments where it has not been set up till date with the Standing Committee Members of the National Council; Convene the meeting of the Departmental Council in all Ministries / Departments once in three months as envisaged in the JCM Scheme.

8. Make the right to strike a legal right and stop curtailment of TU Rights.

9. Implement all Arbitration Awards.

10. Raise the interest rate for GPF; Revise the OTA and Night Duty Allowance and Stitching and Clothing Rates of Uniforms.

11. Merge DA with Pay for all purposes including Pension as and when the DA rates cross the 50% mark

12. Vacate all Trade Union Victimizations.

PART C

1. Immediate action on long pending issues of Scientific Assistants

A. Ensure Track change from SA to SO/TO without out linking additional qualifications

B. Ensure Grade pay Rs4600 to existing SA B and cascading effect should be made to the next higher grades

C. Fulfill the commitment given by the Department in the affidavit filed in the court to maintain the status of Pay & Allowances of SA’s on par with that of Scientific Officer.

2. Restore the promotion awarded to the Work Assistants (erstwhile Mali, Helper, etc) after 01.01.2006 and extend promotional benefits to all by fixing their pay in the next Grade Pay

3. Discrepancies in the technical staff pay & promotion

A. Ensure the promotional benefit for senior most technical staff on par with their juniors as per the revised norms. (Ensure the senior technicians also attaining the Grade Pay of Rs7600 by 33 years as in the case of juniors as per the revised promotional norms)

B. Restore the advance increment given to the CAT II trainees after their successful completion of training and absorption in the Department

C. Entry level for CAT II trainees should be Technician C with additional increment as the case may be

4. Revise the eligibility criteria for Departmental accommodation in the DAE Allotment Rules

5. One more option should be given to all Technical Staff to switch over from CPF to GPF as given by Department of Space

6. Revise all allowances

A. Revise the Overtime Allowance, Night Duty Allowance as done by Ministry of Railways

B. Revise the NRPSA as actual compensation

7. Recruitment Rules and Promotion Norms for auxiliary and DPS Staff

a. Notify immediately the new Recruitment Rules and Promotion Norms for Canteen, Security Staff

b. Notify immediately the new Recruitment Rules Promotion Norms for Purchase & Staff personnel

c. Formulate Promotion Norms for Drivers as applicable in the case of Technical personnel

d. Constitute the Third Cadre Review Committee immediately and ensure representation for NFAEE

e. Action may initiate to convert Store personnel into Technical

8. Remove the discrepancies in PRIS

A. PRIS (G) should be extended to the employees belongs to the supporting units such as DCSEM, GSO, DPS, etc on par with the parent organization for which these units works

B. PRIS (I) should be extended to all auxiliary, administrative, accounts, Purchase & Store personnel during their promotion

C. Before finalizing the PRIS target recognized unions and associations should be taken into confidence

9. Extend Tribal Allowances to the DAE employees on par with the state Government rate where DAE units stationed

10. Restart HWP Tuticorine immediately

11. Ensure Safety & Security of all DAE installations

A. Stop downsizing, out sourcing of DAE activities. Recruit man power in proportionate to the expansion of projects and activities of the Department

B. Immediately scrap all contractual assignment in operational & maintenance, other strategic points such as security, administrative work, etc awarded in various Nuclear installations

C. Follow all Safety regulations stipulated by AERB and BARC Safety Advisory Council

D.

12. Extend facilities to NFAEE offices and Chief executives of the Federation

a. Proper Office facility should be given to NFAEE

b. Telephone, Internet, Fax, permission for using mobile phone, etc, should be extended to the Chief Executive of the Federation.

Please refer to your letter No. 3/4/2011 – IR&W/8 – dated 12th January 2012 in response to the resolution adopted in the General Council meeting held on 23rd November 2011.

As in the said letter requested to submit one or two specific issues for discussion, the same was discussed in the adjourned meeting of General Council meeting held at Mumbai on 22nd January 2012. The meeting takes the imitative from DAE for bilateral discussion as a positive step and extends our sincere gratitude for the same. At the same time it may be difficult for the federation to identify one or two issues for discussion as number of issues are pending for decision with the Department.

Accordingly the General Council authorized to communicate the important issues need immediate attention from the Department.

Accordingly I request you to consider the issues mentioned in the enclosure as agenda for the next meeting with Additional Secretary.

Dear Comrades,

Adjourned meeting of NFAEE General Council was held on 22nd January 2012 at the Multipurpose Hall, BARC Training School Hostel Anushakthinagar, Mumbai to discuss and decided the left agenda of the GC meeting held on 23rd November 2011 at AMD Complex, New Delhi.

The meeting was presided by Com. Vijaykumar Yadav, Working President NFAEE

The General Council meeting observed two minutes silence on memory of Com. Muthuvelu founder member of AEEA, IGCAR Kalpakkam and the veteran trade union leader of DAE trade union movement who died recently after prolong illness.

Secretary General briefed about the developments after the meeting held at New Delhi

The meeting discussed following issues:

I. Request from Department to submit one or two items for discussion

All the participants opined that the initiative of teh Department for bilateral discussion should be taken as a positive step and therefore should submit agenda items for discussion. Decided to submit about 10 major issues pending for discussion

Also decided to write letters on other remaining issues

II. Organisational matters:

a. organisational representation:

To ensure the participation of elected committees in the various organisational fora it is decided to initiate to synchronize the tenure as well as the election year of the Federation and affiliated organisations

b. Accounts

Audited statement of accounts for the year 2010 was presented by the Treasurer for consideration and adoption. The same was adopted by the General Council

c. Request for affiliation

GC Meeting considered the request for affiliation from CAT GANGA. Since CATSA intimated that the Scientific Assistants are members of their association, it is decided to discuss with parent organisation and accordingly a decision shall be taken. The same is the situation in BARC Tarapur, A final decision shall be taken in the working committee meeting,

d. Subscription

General Council meeting appealed to all affiliated organisation to pay subscription dues immediately. It is decided that all affiliates should submit the subscription @ Re 1 per member per month before 10th March 2012.

III. Decision on pending issues:

a. Court case:

Against the decision of the Department to nullify the promotion benefit to the employees from the pre revised pay scale of Rs. 5000 – 8000 to Rs 5500 – 9000 and Work Assistants (previously designated as Mali, Helper, etc), two separate OA has been filed in the Mumbai Bench of CAT. Copies of the both OA is attached with this circular for refearance

The General Council decided to file three OAs in Mumbai, Hyderbad and Chennai respectively against the Department’s attitude on demand of Scientific Assistants on pay structure, promotion, and c track change

The General Council meeting also decided to approach the CAT for revision of OTA

The General Council unanimously nominated Shri Jayaraj KV, Secretary General NFAEE as the National Council Member (JCM) next three years.

Legal Fund:

The General Council decided to raise legal fund for Federation. Starting with raising legal fund to fight three OAs in various CAT, It is decided to collect Rs.1000/- as part payment as legal fund from SAs and sympathisers

Bank Account:

It is also decided to open a new Saving Account in SBI, Anushajthi nagar, Mumbai 400 094 to transact the legal fund separately.

The GC Meeting also decided to print receipts for collecting Legal Fund

a. Nation Wide strike on 28.02.2012

Call given by confederation of CG Employees, Central Trade unions to observe STRIKE on 28th February was endorsed by the General Council Meeting. Copy of the confederation circular is attached.

Along with the Charter of Demands finalised by Central Trade Unions and Confederation of CG Employees and Workers a charter of Departmental level may be added as Part C

As a part of Campaign programme, the secretariat Members and NE Members of NFAEE shall visit units. Detailed programme shall be communicated in short time.

Also poster shall be print and circulate.

Moreover matter for printing pamphlets shall be prepared at the Head Quarters and circulate to all affiliates with a request to print in local languages.

b. International Women Day on 8th March 2012

The General Council decide to organise Seminar, symposium, debate, etc on the occasion of International Women day pm 8th March 2012. Where 8th March is declared Holiday, there the programme shall be conducted on 7th November

c. All India Women Employees Convention

The General Council decided to organise an All India Women Employees Convention to discus about the problems of working women in DAE and to form a departmental sub committee under DAR.

d. National Debate on Safety and security of Nuclear Installations

The General Council meeting appealed to the Department through a resolution to come out with more transparency and confidence buit up measures.

As a part of campaign on safety and security, General Council meeting decided to hold a debate on Kodamkulam – FACTS & FIGURES on 12th March 2012 at Kalpakkam

BRIEF ON THE DISCUSSIONS HELD IN

ANOMALY COMMITTEE MEETING

Confederation of Central Government Employees & Workers circulated the outcome of the National Anomaly Committee meeting held on 5th January 2012 at New Delhi

The IV meeting of the National Anomaly Committee was held on 5.1.2012. The meeting was chaired by Shri Mishra Secretary DOP&T.

The Chairman welcomed all members of Official and Staff Side and expressed New Year Greetings while making his introductory remarks.

The Leader Staff Side also welcomed the Chairman and gave new year's Greetings. The following issues were raised by him and by other Staff Side Members:-

1. Meeting of the National Council and other forums should be convened as often as possible and at least once in four months.

2. The issue relating to increment should be resolved in this meeting.

3. Issues relating to MACP may be allowed to be settled departmentally.

4. The 2 (actually 11) items which have not as yet been included in the agenda should be included and discussed by arranging another meeting.

5. The meeting of the National Council which has not met for about 2 years may soon be convened.

6. Issues relating to Loco Drivers (not getting any benefit of MACP) should be discussed and resolved on priority basis.

7. Several decisions taken in the Railway Departmental Anomaly Committee have been referred to Department of Expenditure long time back, but these have not been disposed of. This may be expedited.

The following agenda items were then discussed on the basis of Status Note given by the Official Side:-

Items No. 1 to 4 & 5 (iii) - Anomaly in fixation of pay band in case of merger of pay scales.

The Staff side reiterated that since the pre-revised scales 5000-8000 [S9]; 5500-9000 [S10]; 6500-9500[S11]; and 6500-10500[S12] were merged and all are given the benefit of placement in the new Grade Pay 4200 equivalent to pre-revised 6500-10500 scale, the starting of the Pay Band 2 cannot be computed on the minimum of the erstwhile S9 Scale of Pay viz., Rs.5000/-. In fact the commencement point of the Pay Band 2 should be at Rs.12090/- based on the minimum of S12 scale [6500X1.86 = 12090] instead of Rs.9300/- computed by multiplying Rs.5000/- by 1.86.

The Official Side however insisted that what has been recommended by the Commission is correct in terms of the above principle stated by the Commission; This was not acceptable to the Staff Side.

The official side then stated that this item may be further discussed in the next meeting.

Item No 5 (i) and 34 & 35 - Reopening of the option for fixation of pay on promotion.

The Staff Side pointed out that the orders reopening the option up to 31.12.2010 was received in the lowest formations late & therefore all persons could not exercise the reopening option and therefore it should be extended up to 31.12.12. Defense Staff Side also raised the issue of not allowing this option to those who have been promoted to Master Craftsman upgraded post as because final orders have been issued late.

The official side agreed to refer these matters to DOPT, which would be considered and decided.

Item No. 5 (iii) - Special Allowance & Qualifying Pay.

The Staff Side pointed out that special qualifying pay may have been treated as allowance but it is treated as pay for purpose of fixation of pay on promotion to higher post. The result is that senior employees who have been promoted during the period 1.1.2006 to 31.8.2008 get the benefit of pre-revised qualification pay when they have been promoted whereas the junior employees promoted on or after 1.9.2008 have been granted the benefit of doubled qualification pay and therefore the seniors are getting fixed at lower stage.

The official Side agreed to look into this matter

Item No.5 (iv) - Anomaly in fixation of pay between Direct Recruits & Promotees.

The Staff Side pointed out that in terms of FR 22 no person who is promoted should be fixed below the minimum of the Pay Scale of the higher post and as the system of Pay Bands have been introduced clubbing several posts, the Commission has devised a formula for fixing the entry pay (which is always the minimum) for fresh recruits. That being the case all promotes have to be fixed not below the said minimum i.e. the entry pay of the fresh recruit for each grade pay.

Official side insisted that what they have ordered i.e. stepping up the pay of promotes to the post subject to certain conditions is more than enough and if there are certain difficulties, these may be referred to be considered.

The Staff Side however insisted that all the conditionalities may be withdrawn and all Promotees may be fixed at the entry pay of that post for the direct recruitee if there is a quota for direct recruitment in that post irrespective of any new recruitee has joined the post or not.

The official side stated that the matter may be discussed in the next meeting.

Item No (v) - Date of Next Increment.

The Staff Side urged for grant of one increment in pre revised pay scale on 1.1.2006 as one time measure in respect of all those whose next increment would be between 1.2.2006 to 30.6.2006 and then re-fixing them in the revised pay band and to grant next increment on 1.7.2006. This is only as a one-time measure and we would not demand similar treatment in respect of others.

The official side then agreed to the above formulation.

Item No 5 (vii) - Temporary Status casual labourers.

The Staff Side pointed out that as per the scheme of Temporary Status, these employees have been granted the pre-revised minimum of Rs.2550-3200 applicable to the lowest post with the benefit of annual increment etc. Therefore so far as pay scale are concerned they are being treated as regular employees. They have to be granted the Grade Pay of Rs.1800 and fixed at Rs.7000 with effect from 1.1.2006 if they are already matriculates and if not they should be given the training and then fixed at Rs.7000 with grade pay of Rs.1800 w.e.f. 1.1.2006.

The official side noted this demand and assured consideration.

Item No.11 - Grant of Revised Allowance w.e.f. 1.1.2006.

After discussion it was indicated that the issue may be discussed further in the next meeting before recording a disagreement if necessary.

Item No 12& 13 - Transport Allowance.

The Staff Side pointed out that the calculations desired by the official side are already available in item no. 13. It has been pointed out that Transport Allowance at the rate of Rs. 3200 granted to those in PB-3 of grade pay Rs.5400 and above is 2.9 times of their pre-revised TA+CCA which was Rs.1100. The Transport Allowance in respect of Grade Pay of Rs.4600 & 4200 has been revised to Rs.1600 which is only 2.28 times of the pre-revised TA+CCA amounting to Rs.700/-.

The demand was that the raise granted in respect of grade pay of Rs.4600 & 4200 should also be 2.9.times of Rs.700 which would work out to Rs.2030.

The official side stated that this is a new demand and cannot be treated as anomaly.

The Staff Side then stated that this item would be included in the agenda of the National Council

Item No.14 - Revision of the existing allowance which are to be replaced by new schemes.

In the last meeting it was stated that if within six months the new schemes are not finalized and introduced, the rates of these allowance like risk Allowance & Patient Care Allowance would be doubled.

The official side agreed to take a decision in this matter within a month's time i.e. latest by 5.2.2012.

Item No.15, 16, 17 - Parity in pension.

In Para 5.1.47, the VI CPC has stated that in order to maintain the existing modified parity between present and future retirees it will be necessary to allow same fitment benefit as is being recommended for existing employees.

Having so recognised the maintenance of parity between the present and future retirees, the Commission has not extended the following liberalization benefits.

- Full pension after completion of 10/20 years of qualifying service

- Last pay drawn for determination of pension if it is more advantageous than the average emoluments and

- 50% of Grade Pay as against 40% of pre-revised basic pension

Benefit of these liberalisations may be extended to present pensioners w.e.f. 1.1.2006 (we do not want arrears) so that parity between present and future retirees is ensured as desired by the VI CPC.

The official side suggested that the matter may be discussed in the next meeting and disagreement if necessary will then be recorded.

The Staff Side also pointed out the latest judgment of full bench of Principal Bench of Central Administrative Tribunal according to which the clarificatory orders issued by Department of Pension dated 30th October 2008 for determining the modified parity has been quashed and Government has been directed to grant 50% /30% of sum of minimum pay in the pay band and grade pay of the corresponding pay scale of the post from which the employee had retired and re-fix the pension / family pension with effect from 1.1.2006 and pay arrears.

The official side stated that the Judgment is being considered and decision would be soon taken.

Item No. 20 - Daily Allowance on Tour.

The Staff Side insisted that rates of daily allowance may be doubled if the present system of reimbursement on the basis of actual expenditure on conveyance, boarding and lodging etc. are not suitable / practicable in the case of employees who go on tour to places where there are no such hotels / restaurants and the Auto drivers do not issue the receipts.

They also pointed out that when all allowances have been doubled and the Railway has also already doubled the rate of daily allowance on tour, why the Government should insist that DA should be at the pre-revised rates which are quite inadequate to meet the expenses on conveyance, boarding and lodging.

The matter was deferred to be discussed in the next meeting.

Item No. 24, 25, 26 - Commutation of pension.

The Staff Side demand is that option of Commutation had been given when a person retires. The commutation was allowed in terms of pension then fixed on the basis of pre-revised pay etc on the day following the date of retirement and in terms of the Table then in force.

If as a result of revision of pay and consequent revision of pension, additional amount of commutation arose the table which was applicable on date of retirement will have to be operated.

The New Table which has come in to force on or after 1.9.2008 cannot be made applicable in determination of additional commutation value which Table was not in existence on date of retirement.

The official side deferred this item for next meeting and to consider recording of disagreement if need be only in that meeting.

Item No. 28 - Grant of Grade Pay of Rs. 5400 in PB-2 for Asstt. Accounts/Audit Officer.

In the last meeting it was agreed that this and other connected issues would be discussed separately outside this forum by the Jt. Secretary (Estt.) & Jt. Secretary (Pers) with the Staff Side.

Though a detailed note has been sent to the above officers, no meeting has been fixed to discuss the note.

It was stated that a meeting would soon be fixed.

As there was no time, it was decided that next meeting of the National Anomaly Committee may be fixed soon and before the Budget session of Parliament commences.

The meeting of the National Anomaly Committee was held today (05.01.2012) as scheduled. 28 items were subjected to discussions. The next meeting of the Anomaly Committee will finalize the left out items. Next meeting may be in the third week of February 2012,

Information has been received from Confederation of Central Government Employees & Workers that the Government has agreed in the Anomaly Committee meeting to grant one increment on 1.1.2006 in the pre-revised scale of pay for all those employees whose increment falls between 1st Feb and 30th June 2006. They will draw their next increment in the new Pay Band on 1st July 2006.

This is applicable only for those who were in service as on 1.1.2006.

The Steering Committee of Government Employees Organisations on PFRDA has given a clarion call to agitate nationwide by staging strong protest demonstrations at all work spots on 22nd December, 2011 on the face of the decision of the Government to move the PFRDA Bill for adoption today in Parliament. The adoption of the bill is one of the most retrograde moves in the path of neo-liberalization surrender to international finance capital by the Government. The steering Committee of Government Employees Organisations on PFRDA Bill met at AIRF Head Quarters ie 4, State Entry Road, New Delhi on 20th December 2011. Following were present.

Decisions:

1. The PFRDA bill is expected to come up in the Lok Sabha on 21st Dec.2011. The Steering Committee calls upon to hold 2-hour demonstration in the work place on 22nd December 2011 against passage of the bill and demanding its withdrawal.

2. In case the bill does not come up in this session for some unforeseen circumstances (which has been extended upto 29th December 2011), the Steering Committee shall write to all MPs on the need to withdraw the Bill. The field formations shall contact the MP of their station and submit the letter.

3. Future agitational programmes shall be decided after the one day strike called by central trade unions on 28th February 2012. The demand 'Assured Pension for all' formulated by Central TUs shall be modified by the constituents of Steering Committee to "Scrap PFRDA bill/NPS; ensure pension for all".

SIGNATURE CAMPAIGN ON PFRDA BILL:

As per the call given by the Steering Committee of Central & State Government Employees Federations, Head Quarters issued copy of the memorandum to be submitted to the Prime Minister to all affiliates and requested to take copies of the memorandum and collect signature form the employees their family members and from general masses. All affiliates are requested to carry our vigorous campaign on signature collection and with a stipulated period in a phased manner collect signature from employees including officers, family members and then from general public. In the recent held National executive of Confederation of CG Employees & Workers the quota for our Federation has been fixed as ONE LAKH. All affiliates are requested to collect maximum signature. MARCH TO PARLIAMENT:

Information from various units is still awaited about the participation in the March to Parliament. Information from BARC, DPS, DCSEM, VECC, IGCAR, RMP Mysore, etc only received till date. All affiliates are requested to send the details immediately.

GENERAL COUNCIL MEETING:

As intimated earlier, General Council Meeting of NFAEE shall be held on 23rd November 2011 at New Delhi. The notice for General Council has been issued. Hence all participants should be reached at New Delhi on 22nd November night positively or early morning of 23rd November 2001 and should book return ticket only for 25th evening trains after participating in the March to Parliament.

CAMPAIGN PROGRAMME ON 24.11.2011

All affiliates are requested to collect the details such as Address, Telephone Number etc. of the Member of Parliament representing the Constituency where the DAE unit stationed and seek an appointment to meet at New Delhi on 24th November to hand over a memorandum on our pending issues.

The National Secretariat of the Confederation met at Bangalore yesterday, ie 22nd October 2011. Due to indisposition, Com KKN Kutty, Secretary General could not attend the meeting. Com SK Vyas, President, presided.

The meeting reviewed i) the preparations for the signature campaign and the March to Parliament on 25th November 2011 and ii) the implementation of calls given by the Confederation on the Charter of Demands. The assessment of the meeting is given below.

1. The Signature campaign on the memorandum to be submitted to the Prime Minister has picked up, but there is a need to constant monitoring so that the target is completed by 15th November 2011. The meeting, therefore, decided to entrust the charge to the Secretariat members as given below.

2. We will be able to meet the target of the mobilisation of 10000 for the March to Parliament on 25th November 2011.

3. The NE members-in-charge may ensure that the convention is completed by 15th November 2011 in all such stations where it is yet not over.

4. On programmes on Charter Demands formulated by National Council of Confederation at its Mumbai meeting it was felt that the momentum is yet to pick up, even though programmes have been carried out in majority of stations.

It was therefore decided to convene the National Council (ie Secretariat members, Chief Executives of affiliates and General Secretaries of State COCs) of Confederation to chalk out future course of action including date for one day strike, in pursuance of the decisions of the Mumbai National Council meeting.

The National Council meeting will be held on 16th December 2011 at Kochi, Kerala. Notice would be issued separately.

5. Com Krishnan, General Secretary, Kerala – where 6-5 lakh signature has already been collected under the banner of Steering Committee – will give brief note on their activity which shall be a model for other COCs to follow.

The Karnataka State Committee of Confederation had organised a well attended Convention on charter of demands in the afternoon session.

Dear Comrades,

Movement against PFRDA Bill;

We send herewith copy of the letter from the Convenor of the Steering Committee, which ofcourse is self explanatory. The Steering Committee as you know came into existence as per the decision taken at the National Convention held at New Delhi to launch programmes of action against the proposed PRFDA Bill. In order to establish mass contact with the public at large to elicit their support for the eventual struggles ahead, the convention had decided to organise a mass signature campaign. The campaign was to be unleashed in all States after organising State Convention; March to the Governor's office etc. The draft for the signature campaign had also been circulated to be got printed by the respective affiliates/state Committees. The signature campaign was meant to elicit the support of the people for our demand that the Government scraps the bill which has been presented to the Parliament for deliberation and adoption. We hope that the petition on which signatures are to be obtained might have been got printed and circulated amongst mass of the employees. We request you to monitor the progress in this regard as we have decided to obtain atleast 10 million signatures in the petition to be submitted to the Honourable Speaker on 25th November, 2011. Needles it is to emphasise that without obtaining the support of the people the struggle against the bill might be difficult to succeed.

The programme slated for 25th November is to organise a massive procession and rally before the Parliament and submit the petition with 10 million signatures to the Honourable Speaker, Lok Sabha. The demonstration must be massive, massive and magnificient enough to receive the requisite attention of the media and the public as also to elicit the attention of the Honourable members of the Parliament. We must take efforts to bring to the kind notice of the honourable members of Parliament of the need to compel the Government to withdraw the ill advised Bill or the same is voted out. To ensure that, a powerful and strong movement has to be brought about outside the Parliament. We must bring to the notice of our members the fact that once the bill is made into law by the Parliament, it would open the gates for sever attack on the present defined benefit pension scheme. The Govt. Will be armed with the powers to tinker with the existing pension affecting adversely the entitlement of pension of the serving employees and Pensioners. Our members who are recruited after. 1.1.2004 have already been excluded from the pension benefit by the Government through an executive fiat. It is our bounden duty to fight for them and ensure that they are covered by the defined benefit pension scheme.

The signature campaign and the March to Parliament, if organised with dedication will raise the public opinion against the bill and will pave the way for it annulment. We appeal to you to do everything possible to make the programme of 25th November, 2011 a grand success and ensure that the old age security in the form of pension of Govt. Employees is not allowed to be snatched away to benefit the rich corporate houses and stock market manipulators. The Steering Committee has decided to organise a two hour demonstration at all work-spots on the date on which the Parliament takes the bill for consideration. We expect the bill to come up for deliberation in the ensuing winter session of the Parliament.

Minutes of the Meeting of Steering Committee held on 15th October 2011

The meeting, as scheduled, commenced at 11.30 am.

The following were present.

After detailed discussion the following decisions were taken.

1. The signature campaign would continue upto 20th November 2011 but at the same time the units shall be directed by each participating organisation to intimate the number of signatures obtained upto 15th November to CHQs of the respective Federations.

The signatures obtained shall be submitted on 25th November 2011.

Memorandum addressed to the Prime Minister shall be signed by the leaders of all participating organisations in the Steering Committee and Members of Parliament and dignitaries and the same shall be submitted to Speaker, Lok Sabha with a forwarding letter with a request to transmit it to the PM for consideration of the Parliament.

2. Each station has to communicate the number of participants in the March to Parliament by 15th November 2011.

The organisations present in the meeting stated their mobilisation for the March as below:

Also, 3000 pensioners are expected to join the March to Parliament.

8. On the day the PFRDA bill is taken up for discussion, 2 hour demonstration shall be held in the work places/offices through out the country by the members of all the participating organisations.

9. Delhi based leaders of the participating organisations will meet on 19th November 2011 at 12 noon at AIRF office. Local leaders of all participating organisations shall be invited to the meeting.

10. The Steering Committee shall meet at 5 pm on 24th November 2011 at AIRF office.

A Parliamentary panel today asked the Central government to increase the rate of return on provident fund for its employees in the light of rising bank rates and EPFO's decision to hike its rate to 9.5 per cent for 2010-11.

"The rate of interest on General Provident Fund (GPF) which is pegged at 8 per cent may be reviewed so that government employees are not put to any disadvantage more so now when the interest rates for bank deposits has also been raised," the Standing Committee on Finance suggested in its report.

If the suggests of the panel finds favour from the government, over 50 lakh Centre's employees will stand to benefit.

The panel headed by former Finance Minister Yashwant Sinha, pointed out that retirement fund body Employees Provident Fund Organiation has also increased rate of interest on PF deposits to 9.5 per cent for 2010-11 from 8 per cent.

The proceedings of the meeting held on 29th July with the Secretary, DAE and the Office bearers of NFAEE is given below:

The meeting was attended by all office bearers except Com Karmegha Pandy (HWP Tuticorine).

The meeting started at 11.30Hrs with exchanging pleasantries and also a bouquet to Chairman, AEC. At the start Chairman, AEC stated that whatever issues discussed in the DC could not discussed in the Chairman AEC meeting and the same way whatever issues discussed here could not be quoted in DC meet.

1) Agreed to meet once in six months by Additional Secretary and(FORMALY ONCE IN YEAR&) as and when meeting sought with Chairman, AEC. In the meantime DAE authorities are directed to find out the arrangement available in other Ministries/Departments where Departmental Council / Federation set up concurrently operating.

2) Model Recruitment rules for canteen employees already put up for AEC for consideration with certain modifications.

3) Cadre review Committee will be constituted at the earliest (Responsibility given to Director Administration, DAE) and the date of implementation can be 1.1.2011. NFAEE views will be sought on Cadre Review proposals.

4) Agreed to consider Technical status for Purchase and Store staff provided if the qualification of Materials Management is accepted. Director, DPS already imitated process of computerization along with those existing incumbents can be imparted some sort of training on materials management. In regard to maintaining equity with similar cadres with Purchase/Stores detailed note is sought.

5) Agreed to consider to initiate proposals for increasing existing 5% to 15% on the lines of DOS for the grade of Driver I and splitting of Staff car, Heavy Vehicle Drivers and Drivers in the plant by considering the responsibility of the Drivers engaged in transportation of radioactive and hazardous materials, heavy vehicle drivers, etc by extending special allowance or other means.

6) AEC already approved the Security Staff promotion norms and to be notified.

7) Attendant/Technician promotion norms anomalies and discrepancies meeting to be sought with Member Secretary, TC and TSC for carrying forward the discussion and redressal.

8) Scientific Assistant – Not ready for re consideration and Chairman was adamant

9) OTA - Director, BARC initiated action in AEC in regard to O&M staff and other round the clock shift personnel.

Remaining points can be discussed with authorities concerned

At the end of the meeting, AEC, Chairman, expressed his unhappiness on serving notice for action programme and expressed his willingness for negotiation. President, Working Presidents, Secretary General and other office bearers explained the reason for servicing the notice for action programme and always believe in dialogue and settlement through negotiation.

The National Executive of NFAEE was held in the evening and reviewed the developments and the outcome of the meeting and in specific the conduct of the Chairman, AEC. All members expressed the conduct of Chairman was not expected and resolved to organise Gate Meeting/ Hall Meeting/Public Meeting on the actual happenings in the meeting within the structured frame work before August 2011

Confederation's National Secretariat Meeting was held in Chennai City [Tamilnadu] on 29th July, 2011. Tamilnadu State Committee of Confederation had made excellent arrangements for the conduct of the Secretariat Meeting.

Dear Comrades,

National Secretariat meeting and its decisions.

The meeting of the National Secretariat of Confederation was held at Chennai on 30th July, 2011. Comrade S.K.Vyas President was in Chair. The following decisions were taken.

1. The campaign for popularising the charter of demands adopted at the National Council meeting held at Mumbai on 1st December, 2010 could not be undertaken in an effective manner as the major affiliate NFPE had to be busy with the preparation of the indefinite strike action.

2. The meeting decided that prior to any action programme; an intensive campaign is a pre requisite. Accordingly the following programmes were chalked out.

(a) Every affiliate will circulate the charter of demands along with the explanatory note amongst the employees. Meetings will be organised in front of all offices to explain the demands to the members. Report of such meetings will be sent to the Confederation CHQ directly. These meetings are to be organised between 5th and 10th September, 2011.

(b) Between 10th and 20th September, 2011 the State Committees of the Confederation will ensure that district level conventions are held and one of the State Committee member deployed to attend such convention in each district. The Sate Committees will send the report of these conventions to the CHQ.

(c) On 28th September, 2011 a massive Dharna programme will be organised in all State Capitals, district and divisional offices. At the State Capitals, a minimum number of 100 comrades will sit in Dharna. Lunch recess demonstrations will also be organised on the same date at the Dharna venue. One of the National Secretariat Members will attend the Dharna programme in each State Capital.

(d) All affiliates will organise a department level convention eliciting participation of the State level Executive on a date convenient to them but before 10th October, 2011. One of the National Secretariat members will make it convenient to attend such conventions.

(e) Rally and demonstration will be held in front of the office of the Chairman, Welfare Co-ordination Committee or any other central located place jointly by all the CGEs in all state capitals on 20th October, 2011.

(f) Immediate steps will be taken by all affiliate to circulate the petition to the Prime Minister on PFRDA bill. Copy of the petition will be handed over to each member to obtain his signature as also his family members and friends. The State Committee will hold a review meeting on 10th October, 2011 to monitor the progress and take necessary steps to expedite the campaign.

(g) The National Secretariat will meet at Bangalore on 22nd October, 2011 to review the implementation of the programme of action including the signature campaign and take necessary action to remove deficiencies if any noticed.

(h) The Confederation will mobilise 10000 employees to participate in the ensuing march to Parliament (date will be finalised by the Steering Committee by end of August, 2011).

(i) To organise a day's strike jointly by all the organisations participated in the 22nd July convention. The date for the strike will be finalised by the steering committee.

NATIONAL WOMEN SUB COMMITTEE OF

Along with the Secretariat, the National Women Sub Committee of Confederation of Central Government Employees & Workers had its session on 30th July 2011 at Chennai.

The Women committee constituted by the National Women Convention held at Kolkata met at Chennai on 30th July, 2011. The Committee took the following decision. The meeting was presided over by the Chairperson, Com. Geeta Ghoshal and the proceedings were initiated for discussion by Com. C.P. Shobhana, Convenor.

1. To organise the International women's day on 8th March, 2012 at all State Capitals by organising a seminar on the subject "impact of the neo-liberal economic policies on women and women workers in particular"

2. To organise a State level Convention of women employees of the Central Government during September/October, 2011. The State Committees of the Confederation will take necessary steps to hold the convention.

3. To hold a demonstration in a prominent Central Government office by women workers in all State Capitals against the unabated price rise of essential commodities. The date will be finalised and intimated later. Steps will be taken to have massive participation of all women employees of Central Government in this programme by the State Committees.

Sub: Discrepancies in the Revised Promotion Norms – Reg

Sir,

Please recall the discussion held on 29th July 2011 with the Secretary DAE and the Office Bearers of NFAEE. During the discussion, NFAEE brought to the notice of the Secretary and other DAE authorities regarding the discrepancies exists in the revised promotional norms approved by the Trombay Council. The norms 2011 for Attendants, Technicians, Nurses, Scientific Assistants, etc needs review as the discrepancies/ anomalies still exist in all these categories. The major issues concern has been circulated during the meeting.

Due to the shortage in time, Secretary, DAE agreed for further discussion on these issues with Secretary, TC and concerned authorities.

You are requested to give us an early appointment to place our concern regarding the discrepancies/ anomalies for review.

PFRDA BILL INTRODUCED IN THE PARLIAMENT:

Dear Comrades,

The UPA Government re-introduced the Bill on PFRDA in the Parliament today (24.03.2011). It is to be recalled that he same was introduced by the earlier Government, but because of the opposition from the left parties, Government could not move with the bill.

It is pertinent to note here that the Joint convention of Confederation of Central Government Employees & Workers and All India State Government Employees Federation given a call to protest against the PFRDA Bill and decided to have protest programme if the Bill introduced.

As the Bill has been introduced today by the Government in Parliament, Confederation of CG Employees & Workers given a call to organize protest programme on 25th March 2011.

Copy of the confederation Circular is attached for ready reference.

All affiliates are requested to organize lunch hour demonstration on 25th March 2011 to express the opposition against the Governments decision.

TO REGISTER OUR STRONG PROTEST AGAINST

THE ATTROCIOUS ATTEMPT OF THE UPA GOVERNMENT

TO REINTRODUCE THE LAPSED BILL

Dear Comrade,

The UPA II Government has today introduced the PFRDA Bill once again in the Parliament. The bill that was introduced earlier by the then Finance Minister, Shri P. Chidambaram, could not muster sufficient support to get enacted as the Left parties opposed it. Even though the enactment could not be made, the Government through executive fiat had converted the statutory defined benefit Pension scheme which is in existence for decades in the case of Government employees into a contributory pension scheme.

The All India State Government Employees Federation and the Confederation of Central Government employees had jointly taken the decision earlier to oppose the introduction of the Bill by organizing a two hour walk out programme. Accordingly we call upon all our Affiliates and State Units to immediately organize demonstration in front of all offices between 12 and 2 PM and mobilize the members for sustained serious programmes of action in the days to come. Intensive campaign programmes must be undertaken to bring home the pernicious impact the bill will bring about on the existing pensionary benefits of the Government employees. Besides, the funds accumulated from the contributions made by the employees as stipulated in the New Contributory Pension Scheme would be diverted to stock market for investment. Since the Government is to contribute equal amount as is being made by the employees, the new contributory pension scheme would be an unbearable drag on the exchequer and the sole beneficiary would be the big corporate houses. We must therefore embark upon a sustained struggle against the new scheme including a day's strike action as and when the bill is taken up for enactment by the Parliament.

Sub: Follow up action of the meeting held on 14th September 2010

Sir,

We would like to draw your kind attention towards the meeting we had with you on 14th September 2010 and the minutes of decisions thereof.

It was decided in the said meeting to form a small committee to analyze the pay structure chosen by DAE on the recommendation of the Sixth Central Pay Commission (SCPC) as the same created anomaly with other comparable scientific Departments. Even after lapses of 4 months the committee has not been constituted.

In the meanwhile we had an opportunity to appear before the Norms Committee constituted by the Trombay Council BARC, Wherein, we were asked to present our views on norms for career progression of technical staff, attendant, etc.

We pleaded with the Norms Committee that the de-merger of the pre revised scales of Rs.5000 – 8000 and Rs.5500 – 9000 was the most to enable and to maintain the horizontal relativity with other categories existing in this department –importantly this was the reference matter for Dr. Suri Committee. The action initiated by the Department to over come the merged pay scale has been further brought financial losses as well as career degradation comparing with other Departments.

Like wise, the career progression and the financial up gradation of ‘Attendant”, the erstwhile Group D employees also been put in stagnated position and the same also been again referred to norms committee. The analogy adopted by the DoPT while formulating MACP and also specific enabling order considering their past service into account for financial up gradation/promotion as the spend service was to be deemed to be the service in the present grade pay. If the yardstick prescribed by DOPT was adopted by DAE, the spent service varying from to 20 to 30 years in majority of the cases by the ‘Attendant’ would have been entitled for added financial up gradation with the promotion norms in vogue as on 1.1.2006 – leave alone the new norms.

The norms committee members expressed that these points to be looked into by the Department or the proposed committee and is not coming under the purview of the Norms Committee.

In the meantime, the office bearers of AEW&S Union, BARC taken up these matters with the Director, BARC in their meeting and the Director too stated that this is the subject matter for the joint committee to be constituted by DAE.

We feel that without addressing the problem of de-merger of pay structure for technical staff and the financial up gradation of Attendants, the norms committee may again meddling with the residential period of the existing categories of scientific, technical and attendants.

If the Norms Committee finalized its recommendation without considering this burning issue, it may further lead to wrongness in the forthcoming days.

Hence we request you to kindly treat the matter is urgent in nature and direct the officials concerned to set right the issues brought in by bilateral discussion with the office bearers of NFAEE at the earliest possible time.

Side by side constitution of the committee as agreed upon in the meeting also to be constituted at once.

Sir,

Reference is invited to the letter No. 3/4/2010 – IR &W/27 dated 15th February 2011 in response to our letter NFAEE letter No.NFAEE/SG/10/123 dated 15-09-2010.

In the above mentioned letter it was mentioned that the Director BARC constituted a Norms Committee vide Standing Order D38 2010 dated October 25, 2010 under the Chairmanship of Dr. A.K. Suri, Director, Materials Group, BARC to review the issues arising out of the formation of various recruitment and promotion norms and the Committee invited various Associations and Unions including NFAEE for presenting their view points. It was further mentioned in the letter that as the views of NFAEE will be taken into account while formulating the recommendation of the Committee for consideration of the Trombay Council there is no necessity to constitute additional Committee for this purpose.

In this regard we would like to mention the following:

The concepts of Joint Committee look into the various issues raised by the representatives of NFAEE is not going to full fill by hearing the view points of NFAEE by Norms Committee headed by Dr. A.K. Suri. It is pertinent to note here that in the introductory remarks, Dr. Suri categorically mentioned that the presentation is only an opportunity for expressing the views and no discussion on issues. Since it was a power point presentation with a time lime limit of 45 minutes a passing reference of various issues pertaining to various categories of non gazetted staff of DAE.

Where as the concept of the Joint Committee is entirely different as the committee will get an opportunity to debate on issues based on the various documents, precedence and can try to reach settlement on various issues based on a healthy bilateral discussion.

NFAEE strongly feel that a Joint Committee is very much necessary to go through the whole aspects of the discrepancies shaped after the implementation of the recommendations of Sixth Central Pay Commission (SCPC) by considering the developments in the Department that the Department has been constituted Committee after Committee under the permanent Chairmanship of Dr. Suri failed to resolve the basic issue resulted after its implementation and come out with surface finished solutions and later created further complications instead of removal of the anomalies.

NFAEE vide our letter No. nfaee/sg/11/026 dated 24.01.2011 brought out the discontentment among the employees to the notice of your good selves

In this situation the Department has to come out with immediate solution for bring confidence among the employees by

• Stalling all directives to recovery of payment made by various DAE units

• Ensuring promotional benefits for Attendants and other auxiliary staff based on the service they rendered in the Department

• Constituting Joint Committee as promised by your good selves for a joint retrospection to resolve all discrepancies, anomalies, and irregularities created after the implementation of the recommendations of SCPC and ensuring the seniors pay and status.

We hope you will consider this as most urgent and will take initiative to resolve the justifiable demands of employees. By which the department also can ensure the whole hearted support to achieve the goals.

I hereby issuing Notice for holding 4th All India Conference of National Federation of Atomic Energy Employees (NFAEE) from 18th December 2010 to 20th December 2010 at the Multi purpose Hall, BARC Training School Hostel, Anushakthi Nagar, Mumbai 400 094. The Conference hsll start at 9.30 am on 18th December 2010. The Agenda for the Annual Conference is given below:

i) To read and confirm the minutes of the previous conference held at Manuguru.

ii) To adopt working report.

iii) To adopt the audited statement of accounts

iv) To appoint Auditor(s) and fix their remuneration.

v) To act as an appellate authority in matters pertaining to the affairs of Federation.

vi) To elect the office bearers as mentioned in Article 19 and the members of the General Council as mentioned in Article 16.

vii) To consider any resolution for which the due notice has been given.

vii) To formulate the charter of demand.

ix) To take such matters not herein specifically provided for with the permission of Chairman.

x) Amendment in the constituition.

All the affiliates are requested to confirm their participation by sending the list of Delegates as well as Observers as mentioned in our earlier letter No. nfaee/sg/10/138dated 22nd October 2010.

With great pleasure we would like to intimate all affiliates and sister orgnaisations that a Reception committee has been formed to conduct the 4th All India conference of NATIONAL FEDERATION OF ATOMIC ENERGY EMPLOYEES (NFAEE) from 18th to 20th December 2010 at the Multi Purpose Hall BARC Training School hostel.

A meeting of the office bearers and activists of union and associations affiliated with NFAEE (AEWSU – BARC, DCSEMSA – DCS&EM, AIAEDPS (Stores) SA - DPS, DPS DAE (Purchase) EA – DPS, HWBEA – HWB, BRITSA - BRIT) , BARCOA, Teaching and Non Teaching Staff Associations, Atomic Energy Retirees Organisation & ARWA was held on 26th October 2010 at the ARWA Hall, Anushajkthi Nagar Mumbai.

Com. Jayaraj KV, Secretary General NFAEE, briefly explained the importance of the Conference and proposed the programmes. P.M.Worlikar (Secretary Staff Side), A. Sreedharan (AEWSU), RS Thokle (HWBEA), Sunil Pawar (DCSEMSA), R.C Durve (AIAEDPSSSA), KG Bilaskar (DPSDAEEA), R.K.MIshra (BARCOA), Anil Jadhav (Teaching Staff Association), Rajan Gaikwad (Non Teaching Staff Association), N.J.Shukla (ARWA), M.P Sankaran (AERWA), etc were participated in the deliberations and assured full co operation to make the conference a grand success.

The meeting elected a Reception Committee consist 101 members with the following Office Bearers:

Presidents and General Secretaries of the affiliated unions and associations stationed Mumbai Shall be the Vice President & Joint Secretaries of Reception Committee. Sangiah, H.C.Tiwari (NFAEE office bearers stationed at Mumbai) shall be Ex officio Members of the Reception Committee.

The meeting also elected various sub committees for co ordinating the functions of the Reception Committee as well as to conduct the Conference effectively.

The Meeting proposed the following programmes to be hold along with delegate session:

• Inaugural Session

• Seminar on Trade Union Movement

• Seminar on Nuclear programme

• Convention of Working Women

• Interactive session with sister organization in the Department, Department of Space, DRDO including Officers Association

• Cultural programme

The meeting adopted a budget of Rs5 lakhs for the conference and decided to rise the fund through collection from the employees of DAE, delegation fee, sponsorship from various organizations, publishing Souvenir etc. To collect the donation from employees it is also decided to print donation coupon of Rs 100/- and blank receipt for collect donation more than Rs 100/-. The meeting also decided to print and distribute an appeal for collecting advertisements for Souvenir immediately.

First meeting of the Executive Committee shall be held on 28th October 2010 and finlaise the formation of various sub committees, tariff for the advertisement for souvenir, delegation fee, etc.

The meeting was presided by Com. PM Worlikar, President AEW&S Union BARC. Com. Jayaraj KV, Secretary General NFAEE welcomed the gathering and Com. KG Bilaskar Treasurer extended vote of thanks to the participants.

Sub: Resolution adopted in the

ALL INDIA CONVENTION OF DAE EMPLOYEES held on 31st July 2010

Respected Sir,

Please refer our letter No nfaee/sg/10/083 dated 2nd August 2010 seeking an appointment in the second week of August 2010 for submission of the resolution adopted by All India Convention of DAE Employees held on 31st July 2010 at the Multi Purpose Hall, BARC Training School Hostel Anushakti Nagar, Mumbai. For the reason of your busy schedule, your offices could not spare the time during that week, so we submitted the copy of the resolution to your office on 13th August 2010.

However we are pleasurable for allowing us to meet you in person to hand over the Resolution which contains the demands pertaining to the DAE employees pending unresolved for long time.

The major issue we feel is that the failure of the Department to continue a healthy interaction with the elected representatives at various level. Although the Federation was recognized by the Department in the year 2007, only three meetings had been convened with the Secretary DAE. It is a sorry to state that the meeting with Secretary and the representatives is only an after effect of notice for strike. The last meeting with the officials was held on 18th February 2009. That too was after effect of STRIKE NOTICE. In the meeting a decision had been consciously arrived to work out a methodology and would be adapted to hold periodic meeting with NFAEE to resolve the issues raised by the NFAEE and its affiliates.

But even after lapses of 18 months, not a single meeting even at the level of Joint Secretary has been convened. In the month of October 2009, NFAEE sought an appointment with the Secretary DAE to discuss various issues, especially the discrepancies created while implementing various recommendations of the Sixth Central Pay Commission (SCPC). Not only meeting has been arranged but also not obligatory response to the various letters addressed. When ever, this Federation approaches the office of the Secretary/DAE, the ready made excuse is the busy schedule of the Secretary. Even after new Secretary took charge, even a courtesy meeting too could not be arranged either the Staff relations officials of DAE or Office of the Secretary.

During this period, a number of letters have been written to the Secretary, Additional Secretary to take necessary proper action to resolve the issues. But, DAE never communicated to this federation – leave alone the letters addressed by our affiliates- what action has been initiated to resolve the problem brought to the notice of the Department.

The JCM functioning in DAE become derision. The Departmental Council meetings are now a day becomes a futile exercise. The Chairman of the Department Council (unique from all other central Ministries/ Departments where Secretary to Government is the Chairman of DC) doesn’t have the time to chair the meeting full day to discuss and settle the issues. Lakhs of rupees are being spent to convene the meeting that too without adequate notice and finish the meeting within hours without any meaningful decisions.

The agenda items submitted for discussion in the DC meeting has been unilaterally taken out and the staff side kept in dark on issues. In the earlier days the Chairman of DC was prepared to sit even two days to complete the proceedings and even small group meeting was arranged to follow up the decision taken. DC meeting become for the sake of calling meeting and treating Joint Consultative machinery in a disdain mood. Earlier days the date of the ensuing DC meeting was tentatively fixed in the meeting itself and strictly adhered to the date also, but now not ready to confirm the month in which next DC will be held.

There are laid down norms for the functioning of Joint Consultative Machinery. But DAE is not bothered about on such norms. If a cursory look at the functioning of our JCM Scheme, it is very much evident that JCM is treated as untouchable. No issues have been concluded in the last so many years. Even after given right up and supportive documents with agenda items, the Chairman simply asking the staff side to submit papers like imposition and simply delay the decision on issues.

Though not liking, let allow us place that the atmosphere created in the Department of Space by sharing the information with the representatives of the employees. The Chairman Space Commission regularly meets the office bearers of the recognized organizations at regular interval and shares the views. He spare times to Chair the Departmental Council meetings regularly resulting in time bound decisions thus effective exploitation of JCM.

In this circumstance the approach towards on the recognized Federation, unions and associations to be reviewed by the Department in a spirited mutual manner and initiate a confidence building measures to deliver the effectiveness of bilateral discussion. A proper system as promised shall be evolved for frequent interaction with the office bearers of NFAEE to sort out the issues raised time to time as the present system of JCM is contending only to Group C employees.

It is therefore we request you to convene a meeting of the office bearers of NFAEE at the earliest to discuss the issues submitted along with this letter. The list of the office bearer is also attached. Since the office bearers of NFAEE are representing various DAE units across the country the date of the meeting may be communicated to all officer bearers in advance so that they can reach at the place of the meet in time. The copy of the resolution adopted in the All India Convention of DAE Employees held on 31st July 2010 is attached herewith

Lastly let we quote Hon. Prime Minister Dr. man Singh’s Independence Day Speech

Discussion and dialogue are the only options to resolve complex issues. As far as the Central Government is concerned, we are ready to take forward every process of talks which could lead to progress in resolution of problems.

CHARTER OF DEMANDS

PART I

1. Price rise of essential commodities to be contained through appropriate corrective and distributive measures like universal PDS and containing speculation in commodity market.

2. Concrete proactive measures to be taken for linkage of employment protection in the recession stricken sectors with the stimulate package being offered to the concerned entrepreneurs and for augmenting public investment in infrastructure.

3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.

4. Steps to be taken for removal of all restrictive provisions based on poverty line in respect of eligibility of converge of the schemes under the Unorganized Workers Social Security Act 2008 and creation of National Fund for the Unorganized Sector to provide for a National Floor Level Social Security to all unorganized Sector workers including the contract/casual workers in line with the recommendation of National Commission on Enterprises in Unorganized Sector and Parliamentary Standing Committee on Labour.

5. Disinvestment of shares of Central Public Sector Enterprises (CPSEs) is not resorted to for meeting budgetary deficit and instead their growing reserve and surplus is used for expansion and modernization purpose and also for revival of sick Public Sector Undertakings.

6. Fill up all vacant posts and lift the ban on recruitment.

7 Stop outsourcing/contractorisation of Governmental functions

8. Regularise all daily rated workers/employees/;Grameen Dak Sewaks and remove the ceiling on compassionate appointments; end the discrimination in the bonus ceiling of GDS employees.

9. Withdraw PFRDA bill and extend the statutory defined benefit pension scheme to all Government employees

10. Guarantee right to strike as a fundamental right of employees.

PART II

1. Initiate bilateral discussion with NFAEE to settle the long pending issues of the DAE Employees which is annexed as Annexure I

CHARTER OF DEMANDS

01. Permanent arrangement to have bilateral discussion with NFAEE on various issue

a. Meeting with Secretary DAE – at least once in six months

b. Meeting with Additional Secretary – at least Once in four months

c. Meeting with the Joint Secretaries – At least every Alternate Months

02. Remove Discrepancies in the Pay Scales and other facilities after the implementation of SCPC recommendations:

a. Pay parity with DOS, as the pay scale of DAE is inferior to DOS pay scales.

b. Protection of fixation benefit on promotion in the merged pay scales in the cases of Scientific Assistant B, Tradesman F, and other equivalent post.

c. Protection of fixation benefit on consequent upon on the upgradation of the pay scale of Mali D/Helper D from the pay scale of Rs2750 – 4400 to Rs3050 -4590

d. Protection of fixation benefit on promotion in the merged pay scales in the cases of Senior Clerk and Assistant and other equivalent post

e. Revise the revised promotional norms issued by DAE/TC which are detrimental to the career and benefits of the Scientific Assistants, Technicians, Attendants, etc.

f. Re-establish the benefit of track change during promotion for Scientific Assistants, Technicians, and Attendants

g. Cadre restructuring of auxiliary staff (Mali, Helpers, Drivers, Security Staff, Canteen staff) to ensure the promotion benefit on par with Department of Space

h. Revise the changes made in the nomenclature of auxiliary staff by converting them as “Multi Skill Staff” and retain the grades of Tradesman personnel to them. Conversion of Attendant to Technician (without any condition) for those who are working in radioactive areas as well as technical/workshop field.

i. Over and above speedy rectification of the discrepancies raised out of the selection of pay structure, revision of norms, etc.

03. Entry level pay for the Technical Staff in the pre revised pay of Rs4000 – 100 – 6000.

04. Uphold the Solomon affidavit given by DAE in the Supreme Court to maintain status, pay & allowances of Scientific Assistants on par with the Scientific Officers in the corresponding grades and mitigate the financial losses

05. OTA revision for R&D and other non industrial unit.

06. Revision of other allowances such as NRPSA, Qualification Incentive, NDA, etc

07. Formulate Promotional norms for Canteen Staff, Security Staff, taking into consideration of the existing employees’ long innings.

08. One more option to switch over from CPF to GPF for Technical Staff.

09. Mitigate the loss in pay due to the merger of pay scales S2 &

S3 as S2A (elongated pay scale) being done in the year 2002.

10. Continuation of Transport Facility.

11. Initiate steps to change the allotment rules based on the basic pay (Pay in Pay band + Grade Pay) corresponding to the pre revised pay to ensure allotment on seniority in place of Grade Pay

12. Withdraw the clarification Order issued by DAE to deduct the PRIS in proportion to the Earned Leave availed in the year 2009 - 2010. Initiate steps to ensure the Bonus to employees who are not getting PRIS

13. Stop the contractorisation/outsourcing

14. Fill all vacant posts

15. Lift the 5% ceiling on compassionate ground appointment

RESOLUTION ADOPTED IN TEH ALL INDIA CONVENTION OF DAE EMPLOYEES HELD ON 31ST JULY 2010

RESOLUTION

The All India Convention of DAE Employees held on 31st July 2010 at the Multi purpose Hall BARC Training School Hostel Anushakthinagar Mumbai unanimously resolved to urge the Chairman, Atomic Energy Commission to solve the problems of DAE Employees.

The Convention took serious note on the anti labor approach of the Department by adopting various method. Systematic down sizing of the work force, outsourcing of the departmental activities, curtailment of the facilities including social security benefits extended to the employees, denial and delaying of the promotional avenues, cadre restructuring etc of all section of employees such as technical, administration, auxiliary, purchase & stores and violation of safety norms, etc are some of the examples of the adversely affecting the employees of our department.

Though the Department completed glorious SIXTY years of our existence and the activities of Department divided the working as Research & Development, Industrial, Services & Support, Public Sector Undertakings (PSUs) and Aided Institutions, the problems facing by the work force in the Department generally are common.

Considering the strategical importance of the Department, the Government has exempted DAE from the application of various general guidelines issued to other conventional departments, in matters of financial power, recruitment and promotion policies, exemption from CPWD for construction etc. But to ensure better utilizing such exemption, it is seen that DAE is competing with other Departments for implementing recommendations of various guidelines of the government to curtail the facilities available to its employees.

The convention noted with concern that in DAE the tendencies to deviate from all democratic norms are increasing. These occur in the day to day functions of the department in various areas such as the interviews for promotions, ensuring working atmosphere for employees, approach in various redressal forums including JCM fora, victimization of association activists, extending facilities to the recognized unions and associations etc. The JCM functioning has become artificial. It is pertinent to note that Department took more than 5 years to accord recognition to NFAEE under CCS (RSA) Rules 1993, though it fulfilled the required norms stipulated in the said Rule framed by DoPT. Even after recognition, the Department is least bothered to take note of “NFAEE is recognized”. The Department is initiating dialogue with the Federation only after serving the notice for strike or any other industrial action. The last meeting held with NFAEE was on 18th February 2009, exactly 18 months before, that too after – effect of a strike notice. NFAEE’s repeated plea to meet the highest authorities for discussion has been treated as disdain.

The convention places its indignation that Department had constituted committees after committees for the sake of upgradation of pay structure, then for cadre review of the administrative, auxiliary and Purchase & Store staff etc. At last the Cadre Review Committee report has been implemented with effect from 01.01.2006, but the benefit of the Cadre review for administrative as well as auxiliary staff has been nullified as the merger of the scale and upgradtion of the feeder grade snatched the promotional fixation and non consideration of cascading effect.

This convention also noted that while recommending Pay scales for various categories, Pay Commission stipulated various situations to select the proper pay structure based on the responsibility, experience, area of the work, etc. But such stipulations are never followed for selecting the pay scales and instead just adopted the corresponding pay scales recommended in lieu of the existing pay scales. This results in great injustice to the serving/existing employees.

Though the Technical Staff of this Department is covered under the merit promotion scheme, it never appears to be really on merit. The frequent alterations by the Trombay Council in the Scheme, question the merit of the Scheme itself. Such alterations to curtail the promotional avenues resulted in desperation among the senior employees as the Departments approach always cut the opportunities of the existing employees.

After the implementation of SCPC recommendation Department has been revised the norms for promotion of Technical Staff, Supervisory, Auxiliary staff, etc and taken away the facilities extended to the employees such as residency period has been enhanced, number of promotional avenues reduced, fixation benefit has been curtailed, track change facility is withdrawn, etc are some of the adverse impact of modified career progression for DAE employees. Merger of the feeder and promotion posts has taken away the promotional benefits and its meaning.

This convention of DAE Employees further noted with serious concern that the Department never consider seriously to enhance the allowances extended to the employees periodically. The Overtime Allowance was continuing in the R&D establishments and other service organisations at the rate of the pay based on the 4th Central Pay Commission. Though the father of the nuclear programme, Dr. Homi Bhabha using his position could convince the Government the special status of the Department and approve the proposal for Over Time Allowance on par with the industrial units. But in the last 20 years who ever swearing in the name of Dr Bhabha failed to protect the interest of the employees

The employees of all DAE units irrespective of the Sector they belong are at risk of being exposed to various hazards such as radiation exposure, chemical hazards, high temperature, and so on. To compensate such risks to the employees, no special package has been considered by the Department, either in the name of attractive pay packet, allowances or extending other facilities such as protein diet, subsidized canteen facilities, etc

Reduction in man power, introduction of contractorisation/outsourcing and privatization at various levels, compromise in safety norms, etc becomes routine. Various guidelines from International agencies, AERB norms, BARC Safety Councils’ guidelines, other statutory directives, etc are being violated by entrusting the radioactive related activities to casual labourers or workers on contract. The reduction of staff results in non-completion of the projects in time, compromise in quality, threat to security, etc.

Department has been intensifying the downsizing, privatization and out sourcing of all activities. Though Government lifted the ban on recruitment Department continues abolition of posts and out sourcing the activities. Even the core activities such as medical system, operational activities, etc also outsourced by engaging para medical staff, plant operators, scientific assistants, engineers, etc on contract. Department already initiated action to out source various activities such as transportation, canteen, security service etc by handing over the same to private contractors. The repeated warning of the Home Ministry and other intelligence agency on every occasion of imminent threat and need of beefing up of security measures does not bother the departments’ approach on handing over the security, transport, canteen facilities, etc in the private hand.

A threat now has now arisen to closure of certain units of Heavy Water Plants and the employees demand of diversification of activities in these plants have not been considered with attention and serious note in particular to Tuticorin Plant.

The all India Convention of Atomic Energy Employees therefore demands the Central Government and the Department of Atomic Energy:

 To initiate bilateral discussion with NFAEE to settle the long pending issues at the earliest

 To stop outsourcing, privatization, downsizing, contractorization, casualisation of the activities of various sectors of DAE.

 Revisit the Modified Merit Promotion Scheme to hold the merit change over and the beneficial previous promotional avenues.

 To retain the facilities of Track Changing, and advantageous promotion benefits existed earlier in DAE

 To exploit the beneficial requisites recommended by the Pay Commission while selecting Pay scales for all section of employees.

 To revise the Over time Allowance in all R& D establishments and other units based on the revised pay.

 To revise all other allowances such as NRPSA, NDA, QIS etc

 To withdraw the 5% cap and other restrictions on compassionate ground appointments.

 To introduce Special pay structure, Radiation/Hazardous/Risk allowance to the employees who are exposed to radiation, hazardous chemicals, excessive heat etc and provide protein diet, subsidized diet, etc to the employees.

 To cover the all employees of DAE and their families in the Nuclear Liability Bill

 To ensure the application of scientific temperament in the day to day activities and ensure democratic approach on all issues.

 To start diversified activities and restart the stalled production of Heavy water Plants viz. Tuticorin etc and take appropriate action in time to avoid such situation in other DAE units

 To continue the special status in all respects to DAE which had been considered as a scientific department and given a special status in comparison with other conventional departments

This convention of DAE employees unanimously adopted the Charter of Demands based on the wider consultations done by holding category wise meetings on 29th July 2010 and the inputs received from the employees which is annexed along with this Resolution.

The Convention of DAE employees once again urge the Chairman Atomic Energy Commission to intervene and initiate bilateral discussion with the National Federation of Atomic Energy Employees and find solution to the issues pertaining to the employees in order to deter the resentment

CHARTER OF DEMANDS

01. Permanent arrangement to have bilateral discussion with NFAEE on various issue

a. Meeting with Secretary DAE – at least once in six months

b. Meeting with Additional Secretary – at least Once in four months

c. Meeting with the Joint Secretaries – At least every Alternate Months

02. Remove Discrepancies in the Pay Scales and other facilities after the implementation of SCPC recommendations:

a. Pay parity with DOS, as the pay scale of DAE is inferior to DOS pay scales.

b. Protection of fixation benefit on promotion in the merged pay scales in the cases of Scientific Assistant B, Tradesman F, and other equivalent post.

c. Protection of fixation benefit on consequent upon on the upgradation of the pay scale of Mali D/Helper D from the pay scale of Rs2750 – 4400 to Rs3050 -4590

d. Protection of fixation benefit on promotion in the merged pay scales in the cases of Senior Clerk and Assistant and other equivalent post

e. Revise the revised promotional norms issued by DAE/TC which are detrimental to the career and benefits of the Scientific Assistants, Technicians, Attendants, etc.

f. Re-establish the benefit of track change during promotion for Scientific Assistants, Technicians, and Attendants

g. Cadre restructuring of auxiliary staff to ensure the promotion benefit.

h. Revise the changes made in the nomenclature of auxiliary staff by converting them as “Multi skilling Staff” and retain the grades of Tradesman personnel to them. Conversion of Attendant to Technician (without any condition) for those who are working in radioactive areas as well as technical/workshop field.

i. Over and above speedy rectification of the discrepancies raised out of the selection of pay structure, revision of norms, etc.

03. Entry level pay for the Technical Staff in the pre revised pay of Rs4000 – 100 – 6000.

05. OTA revision for R&D and other non industrial unit.

06. Revision of other allowances such as NRPSA, Qualification Incentive, NDA, etc

07. Formulate Promotional norms for Canteen Staff Security Staff,

etc. taking into consideration of the existing employees’ long innings.

08. One more option to switch over from CPF to GPF for Technical Staff.

09. Mitigate the loss in pay due to the merger of pay scales S2 &

S3 as S2A (elongated pay scale) being done in the year 2002.

10. Continuation of Transport Facility.

11. Initiate steps to change the allotment rules based on the basic pay (Pay in Pay band + Grade Pay) corresponding to the pre revised pay to ensure allotment on seniority iin place of Garde Pay

12. Withdraw the clarification Order issued by DAE to deduct the

PRIS in proportion to the Earned Leave availed in the year 2009 - 2010. Initiate steps to ensure the Bonus to employees who are not getting PRIS

DECLARATION

ADOPTED IN THE ALL INDIA CONVENTION OF DAE EMPLOYEES HELD AT THE MULTI PURPOSE HALL, BARC TRAINING SCHOOL HOSTEL, ANUSHAKTHI NAGAR, MUMBAI ON 31ST JULY 2010

The All India Convention of DAE Employees held at the Multi Purpose Hall, BARC Training School Hostel, Anushakthi Nagar, Mumbai on 31st July 2010 took serious note on the anti labor approach of the Department by adopting Systematic down sizing of the work force, outsourcing of the departmental activities, curtailment of the facilities including social security benefits extended to the employees, denial and delaying of the promotional avenues, cadre restructuring etc of all section of employees technical, administration, auxiliary, purchase & stores and violation of safety norms etc are some of the examples of the adversely affecting the employees of our department.

Considering of the strategically importance of the Department Government has been exempted from the application of various general guidelines issued to other conventional departments, such as in matters of financial power, recruitment and promotion policies, exemption from CPWD for construction etc. But to ensure betterment utilizing such exemption, it is seen that DAE is competing with other Departments for implementing recommendations of various guidelines of the government to curtail the facilities available to its employees.

This convention noted with concern in DAE that the tendencies to deviate from all democratic norms are increasing. These occur in the day to day functions of the department in various areas such as the interviews for promotions, ensuring working atmosphere for employees, approach in various redressal forums including JCM fora, victimization of association activists, extending facilities to the recognized unions and associations etc. It is pertinent to note that Department took more than 5 years to accord recognition to NFAEE under CCS (RSA) Rules 1993, though it fulfilled the required norms stipulated in the said Rule framed by DoPT. Even after recognized by the Department they were least bothered to consider NFAEE is recognized. The Department is initiating dialogue with the Federation only after serving the notice for strike or any other industrial action. The last meeting held with NFAEE was on 18th February 2009, exactly 18 months before, that too after – effect of a strike notice. Our repeated plea to meet the highest authorities for discussion has been gone to the ears of deaf & dump.

The convention places its indignation that Department had constituted committees after committees for upgradation, then for cadre review of the administrative, auxiliary and Purchase & Store staff. At last the Cadre Review Committee report has been implemented with effect from 01.01.2006, But the benefit of the Cadre review for administrative as well as auxiliary staff has been nullified as the merger of the scale and upgradtion of the feeder grade denies the promotional fixation

Though in the prevailing condition, the Atomic Energy Act does not permit the entry of Private Nuclear Industry, the Government introduced Nuclear Liability Bill in which various clauses are serious to concern for work force as well as to the general public. Various political parties, organizations, intellectuals, former scientists and technocrats have expressed their views through media, seminars and various other agencies and emphasized the necessity of the debate on the issue government is trying all the best to get the node of Liability Bill. it is unfortunate to note that the senior working scientists, technocrats, representatives of the recognized unions and associations have not been taken into confidence on the issue and no attempt has been made by the Department to assess the gravity of the issue by initiating debate among the policy makers as well as the applicants among the department, senior scientists and technocrats, representatives of the recognized organizations etc.

This all India Convention of Atomic Energy Employees therefore demands the Central Government and the Department of Atomic Energy:

 To initiate bilateral discussion with NFAEE to settle the long pending issues.

 To stop out sourcing, privatization, downsizing, contractorization, casualisation of the activities of various sectors of DAE.

 Review the Modified Merit Promotion Scheme to ensure the earlier promotional avenues.

 To consider all stipulations/ conditions recommended by the Pay Commission while selecting Pay scales for all section of employees.

 Retain the facilities of Track Changing, and other attractive promotion benefits existed earlier in DAE

 To continue the special status in all respects to DAE which had been considered as a scientific department and given a special status in comparison with other conventional departments

 To revise the Over time Allowance in all R& D establishments and other units based on the revised pay.

This Convention urges upon all organizations of DAE employees to unite and mobilize the employees for a sustained campaign programme which may culminate in agitational programme in order to realize the demands.

Accordingly this convention of DAE employees unanimously resolved to adopt the Charter of Demands prepared based on the wider consultations done by holding category wise meetings on 29th July 2010 and the inputs received from the employees.

The convention also resolved to stage the following action programme:

 Seek an audience with Chairman Atomic Energy Commission to submit the CHARTER OF DEMAND prepared in the above manner by leading a NFAEE delegation on 9th August 2010 and to demand initiate immediate bilateral discussion with NFAEE.

 Submit the CHARTER to all Head of Units by the affiliated unions and association on same day with a request to foreword the charter to the Chairman AEC

 Serve STRIKE NOTICE on 17th August 2010 including our charter apart from the 10 point charter of Demand decided by the Confederation of Central Government Employees & Workers and State Government Employees Federation and All India Defence Employees Federation

 Evening DHARNA to be staged on 26th August 2010 on the eve of Departmental Council meeting which is scheduled to be held on 27th August 2010

 Attend the DC meeting by wearing BLACK BADGE to protest against the non implementation of the commitment given by the Chairman AEC to introduce methodology for bilateral discussion with NFAEE to settle the demands

 Approach various statutory forums Viz National SC/ST Commission, National Minority Commission, Ministry of Social Justice, Petition Committee of Loksabha, Standing Committee on S&T, etc to CONVEY the approach of the Department in the service matters such as pay structure, promotion, other facilities etc prejudicial to the interests of socially oppressed section.

 Hold a huge DEMONSTRATION at New Delhi during the winter session of Parliament.

The convention calls upon all affiliated unions and associations, unions and association on NPCIL employees and Aided units to make all these programmes a success and display the unity.

Apart from the affiliate organizations office bearers from AMD Employees Union, AMD Hyderabad also participated in the meeting.

Before initiating the agenda for discussion the meeting paid Homage to Com. Jyothi Basu, veteran trade union leader and leader of the communist movement in India and the former Chief Minister of West Bengal for 23 years who died on 18th January 2010. Also the meeting respectfully paid homage to Mahatma Gandhi on the occasion of observing 30th January as martyr’s day.

In the brief Presidential address, Com. Maniachari mentioned the attitude of the department as well as the need of the united movement.

Agenda: Briefing by Secretary General

Secretary General briefed in length about the developments after the last Working Committee held at Chennai in the month of August 2009. As per the decision in the last Working Committee anomalies were invited from affiliates and their members and the same was scrutinized in the Secretariat meeting held at Mumbai on 09.11.2209 and finalized anomalies were submitted to the Department on 12th November 2009. He further explained the decision taken in the Secretariat meeting held on 9th November 2009.

During the period number of issues were taken up with the Department and wrote letters to DAE, BARC other ministries such as MOUD, PMO office etc on various issues. Representation on revised criteria on allotment of Departmental accommodation was submitted to the Cabinet Minister, MOUD as well as the Additional Secretary and Director MOUD, and on various departmental issues to the Minister for state, PMO. A delegation also met Shri Prithvi Raj Chauhan, Minister for State, PMO office at his home town, Karad, in Satatra District and submitted a detailed memorandum.

National Council meeting of Confederation of Central Government Employees & Workers was held at New Delhi from 4 – 6 December 2009. Following office Bearers of NFAEE attended the Council meeting:

In the newly elected Secretariat of Confederation of CG Employees & Workers com. Jaraj.kV elected as Assistant Secretary and Com. Maniachari elected as Organising Secretary.

During the period attended the general body meeting of ISRO SA at Trivandrum on 16th January 2010 and the office inauguration of the ISO Staff Association, which was held on 14th January 2010. A formal meeting of the office bearers of SEFI and various associations DOS was held on 14th January 2010 and exchanged the recent developments after Joint convention held at Chennaii on 10th August 2009

Also the Secretariat meeting of Confederation of Central Government Employees & Workers at New Delhi was held on 18th January 2010. The meeting decided to hold massive demonstration on 25th February 2010 against the Price Rise, Introduction of PFRDA Bill and against the new proposed Direct Tax Code in front of all Central Government Offices.

NFAEE took up the issue of holiday In lieu of Bakrid at Mumbai and other places were leave was not declared and we succeeded to declare holiday.

When the Patient Care Allowance was stopped by the DAE the issue was taken up with the Department as well as with Ministries concerned and now PCA extended upto March 2010.

Agenda: Briefing by Secretary Staff Side about the Departmental Council meeting held on 29th January 2010

In the briefing the Secretary Staff side mentioned that the Chairman of the DC was more particular about the lettering by the staff side on various issues and asked to take more cautious approach on using words while drafting letters. Though the Chairman was not ready to consider the amendments in the draft minutes circulated but after deliberations he consider certain amendments in the minute submitted by the staff side.

In the action taken report the Chairman started to direct the staff side submit fresh proposals, documents etc on various agenda which was discussing years together. On various issues such as promotion norms for Drivers, Fire Staff, Canteen Staff, mode of implementation of Cadre Review, Data Entry Operators Township supervisors and other isolated categories etc, the Chairman asked to submit detailed proposals.

Out come of the agenda items:

Out of the four fresh agenda items, three has been agreed:

1. Agreed to give option for female employees to select salwar, kames and duppatta or saree, blouse and petticoats to female employees

2. Payment of Child Education Allowance for the yea r 2008 as per the guidelines issued by the nodal ministry on 11.11.2008 (in pro-rata basis)

3. Agreed to refer the issue for clarification/confirmation to include transport expenditure for children to go to the schools and purchasing of Schools bags.

However the agenda item pertaining to the Promotion Norms for Nurses was not agreed as the Department intimated that the effected nurses don’t have such grievances.

Com. S.K Panchal Member National Council (JCM) and Com. Anuradha (Leader Staff side) talked about the approach of the Chairman DAE Departmental Council meeting and expressed conformity with the views expressed by the Secretary Staff Side. Leader staff side also mentioned that the agenda item could not place for discussion shall be taken for discussion in the next DC meeting which shall be held in the 2nd or 3rd week of May 2010.

Thereafter discussion on report of the Secretary General on organizational and Departmental issues as well as on the out come of the DC meeting was held in detail. Following members were participated in the discussion:

In the discussion the participants expressed their concern about the attitude of the DAE authorities on various, delay in extending facilities to NFAEE and the delay in introducing a mechanism for bilateral discussion with NFAEE, delay in convening the anomaly committee meeting, weakness in the staff side activities in coordinating the Departmental Council related matters such as compiling the agenda from various affiliated unions/ associations, changes in the criteria for departmental accommodation, changes made in the promotion norms, promotional avenues for group D employees such as Helpers, security Staff, Canteen staff, parity in pay scales of Technicians/scientific assistants with nurses, revision of OTA, revision of NRPSA, increment for those Tradesman E got promotion to Tradesman F, promotion from Helper D to Tradesman A, etc.

While participating in the discussion Shri Vasu, General Secretary AMD Employees Union intimated that due some internal problem forced to disaffiliate from NFAEE, but now a decision has been taken to affiliate with NFAEE and to join in the main stream trade union movement of DAE employees which was accepted by applauses by the participants of the meeting.

After detailed discussion the meeting took following decisions:

1. Endorsement of decisions of NFAEE Secretariat as well as Confederation of CG Employees & Workers:

The meeting endorsed the decisions taken in the Secretariat meeting held on 09.11.2009 and the decision taken in the Secretariat meeting of Confederation of Central Government Employees to observe demonstration on 25th February 2010 against the Price Rise, PFRDA Bill and Direct Tax code.

2. Mass demonstration:

The meeting decided to hold massive demonstration by wearing Demand badges as well as holding lunch hour meeting in all DAE units on 25th February 2009 as per the call given by the Confederation of Central Government Employees & Workers. The meeting also decided to add the following issues in the Charter of Demand:

a. Initiate bilateral discussion with NFAEE on issues raised by the Federation

b. Convene the meeting of DAE anomaly committee immediately at resolve the anomalies/discrepancies within the time frame prescribed by the Ministry of Personnel

c. Gave away the Grade Pay criterion for Departmental accommodation and continue the basic pay as criteria for allotment of Departmental accommodation

d. Review the promotion norms introduced after the implementation of 6th CPC recommendations for Technical Staff

3. Suggestion on various issues:

The meeting further decided to call views from all affiliated unions and association on following issues immediately.

a. Recruitment & Promotion norms for Drivers

b. Recruitment & Promotion norms for Canteen staff

c. Recruitment & Promotion nor Security Staff

d. Recruitment & promotion norms for Fire Service Staff

e. Recruitment & promotion norms for isolated categories such as dispatch riders, care takers, township supervisors, etc

f. On ACP/MACP for various categories employees

g. Methodology of implementation of 2nd Cadre Review. In the DC Chairman DC proposed that for UDC post DAE shall agree for 40 – 60 against the proposal submitted by the Staff side/NFAEE. i.e., 40% for seniority and 60% for examination where we demanded 60% for seniority and 40% for examination.

All affiliates are requested to submit their consolidated views before 12th February 2010 by email/Fax or speed post to the undersigned

4. Organisational Matters:

a. Conference:

The conference of NFAEE is due in the year 2010. All affiliates due for their election in the year 2010 should conduct their election before 31st March 2010 and the new committees should take over the charge before 30th June 2010. Thus the Conference of the Federation shall be hold before 30th September 2010 a Kalpakkam. JAC of the Kalpaakam should confirm their willingness immediately after discussing in the JAC in which all affiliated organizations of Kalpakkam based units are members. The date and agenda for the conference shall be finalized in the next working committee

b. Amendments in the constitution:

The Secretary General briefed the views of the Secretariat regarding the need of amendments in the certain clauses of the existing constitution of NFAEE

i. Functioning of Secretariat: The functioning of secretariat is week, as the participation of all secretariat members could not ensure in the secretariat meeting as in between changes happening in the unit level election. To over come this difficulty proposing a secretariat of lesser number, maximum of 7 members elected from the Conference along with Leader & Secretary of DAE Departmental Council and the National Council Member (JCM). The conveyance & other incidental expenditure of these Secretariat members barring Secretary Staff side and Leader staff side shall be bared by NFAEE HQ. Expenditure of Secretary Staff Side & Leader staff side should bear by the association/union, which they belong to.

ii. Subscription: Proposed to increase the rate of subscription from affiliated unions/associations as Re1 per member per month (Rs12 per member per year) in place of Rs5 per year per member

c. Payment of Subscription/Donation dues:

All affiliates should pay the subscription upto the year 2009 before March 2010. Also the association/union due to pay the donation collection also should remit the amount/ receipt books etc if any to the Treasurer before 31st March 2010. The Working Committee meeting has also been decided to request the AMD Employees Union to fulfill the formalities to affiliate with NFAEE.

5. Seminar/symposium:

The meeting decided to conduct two or three seminar/symposium on various issues such as:

1. Safety & Industrial regulations

2. Negotiation skills and JCM functions

3. Recruitment/promotion norms of various categories of employees

4. Impact of the liberalized policies of the Government in DAE

The Seminar on Negotiation skills and JCM functions & on the revised norms of recruitment/promotion of various categories of employees shall be held at Mumbai during the next Departmental Council meeting.

The unions and associations are requested to consider in their executive committee to host the seminar on other two issues and intimate at the head quarters, so that those programme also can be conduct before the next conference of the Federation.

6. NFAEE HAND BOOK:

NFAEE also decided to release NFAEE hand book on various rules & regulations pertaining to government employees, pay structure, new promotion norms, various allowances, advances, etc. The book may contain about 50 - 60 pages in the form of a handbook. All affiliates are requested to submitted their requirements by 19th February 2010

7. FED FUSION:

Next issue of the FED FUSION, the monthly organ of NFAEE shall be issued in the first week of March 2010. Affiliates are requested to send their requirement (number of copies) before 25th February 2010. Also requested to send the matters if any to be printed in the next issue of FED FUSION, by EMAIL before 21st February 2010 to the undersigned. Next issue of the FED FUSION shall be in 16 – 20 pages and the cost shall be Rs5/- per copy.

8. FUNCTIONING OF DEPARTMENTAL COUNCIL:

The meeting also discussed the functioning of the staff side of DAE Departmental Council and decided to improve the functioning. Following steps proposed to adopt for smooth function of the Departmental Council.

a. Prepare agenda for the ensuing Departmental Council meeting well in advance and hand over the same by the DC members/Association to the Secretary Staff side while coming to attend the meeting of the Departmental Council called for. A copy of the agenda should be marked to NFAEE also for compilation and co ordination.

b. Fresh agenda any should be submitted within 30 days from the day of the last DC meeting. Copy of the agenda should be marked to NFAEE also for compilation and co ordination.

c. All agenda items should prepare with proper supportive documents.

d. Agenda should be submitted in hard copy by post or hand delivery as well as soft copy by email. Secretary Staff side as well as the Secretary General NFAEE should acknowledge the receipt of agenda from the affiliates/DC members concerned by post/email as the case may be.

e. Within 40 days from the date of the last DC meetings meeting of the Office bearers available at Head Quarters, Office Bearers and DC members of unions and associations stationed at Mumbai should be convened by the Secretary Staff side and scrutinized the agenda items received form affiliates for duplication, verification of the fact etc and if necessary re-circulate through email for additional clarification/ more information etc with a request to submit within 5 days..

f. There after the finalized agenda items should be submitted to the Department well in advance so that the department can come with proper preparation in the DC meeting.

g. The DC members at the Head Quarters should meet regularly to follow up the action taken on DC agenda items as well as to confirm the date of the DC meetings, minutes, copies of action taken, correction in the DC meeting minutes, etc.

h. As the next DC meeting is scheduled to be held in the middle of the month of May 2010, it is decided that al affiliated unions and associations and their DC members should send the agenda items if any to be submitted for consideration in the ensuing DC before 1st March 2010 through EMAIL as well as by POST along with the relevant/supportive documents to the Secretary Staff Side and to the Secretary General NFAEE. The same shall be scruitinised before 10th March 2010 and shall be circulated to all affiliates and after getting confirmation/correction the agenda items shall be submitted to the Department for inclusion by 20th March 2010.

9. ABOUT PRIS:

The meeting also discussed about the Performance Related Incentive Scheme (PRIS). The members sought clarification about the various versions spread out across the units regarding the continuation of PRIS. Secretary General mentioned that based on the information received from DAE that so far no decision has been taken by the Department to withdraw or to put on hold the Scheme. Certain queries have been raised by the Ministries/Department of Expenditure regarding the mode of implementation of the Scheme and our Department along with DOS is in interaction with the concerned.

However, after a detailed deliberation, it is decided that in any case, if the Department/Government decided to withdraw PRIS, spontaneous response should be there from the employees and to give a call the Working Committee authorized the Secretariat and the Working Committee members at the Head Quarters to assess the situation and to interact with SEFI and their leaders and give a call for action

The Working Committee adopted resolution on following:

1. To urge the Department to stop the transfer at HWP Tuticorine and start the operational activities of the Plant immediately

2. To communicate the concern about the remarks of Chairman DAE DC

Fire at Bhabha Atomic Research Centre, 2 killed

Mumbai: A fire broke out Tuesday (29.12.2009) in a chemistry lab at the Bhabha Atomic Research Centre (BARC) located just a kilometre away from the nuclear reactors leaving two persons dead but scientists said there was no danger of any radioactivity.

Scientists at suburban Trombay-based BARC said there was a loud bang in the chemistry lab after which black smoke billowed out. It was not immediately clear if the bang was caused by any explosion or triggered by a chemical reaction.

No research involving radioactive material is conducted in the multi-storied modular lab in which the chemistry lab was housed, they said.

It was also stated that no reactor, radioactivity or radiation is involved in the accident.

The victims were yet to be identified as the bodies are charred beyond recognition, a BARC release said. But sources said they could be trainee scientists. Some equipment was also damaged in the blaze, scientists said.

"The fire broke out at 12:05 hours in the chemistry lab on the third floor of the modular lab of BARC. There was a loud bang after which black smoke billowed out of the chemistry lab filling the corridor," BARC director and Atomic Energy Commission Chairman Sreekumar Banerjee said.

BARC fire brigade officials rushed to the spot and doused the blaze within 45 minutes after. The fire-fighters later made their way to the lab negotiating broken windows and located two badly charred bodies.

The laboratory has been cordoned off and police was conducting investigations. The cause of the fire is yet to be ascertained. Forensic experts also joined the investigations.

The chemistry lab stored scientific equipments like spectrometers for kinetic and spectroscopy measurements.

"All these instruments were burnt in the fire but fortunately the fire did not spread to the other labs in the building," Banerjee said.

Usually, seven people worked in the lab but today only two were there.

The modular lab at BARC is home to a number of departmental labs and hundreds of people work on different floors of the building. Instruments, chemicals and gadgets required for research are stored at the labs.
